One of the most common mistakes is not realising that not all rentals are the same. In Ibiza, there are three legal ways to live in a property, each with very different rules, rights, and obligations. Understanding these differences is key to avoiding problems from the very beginning.
Holiday rentals in Ibiza are strictly regulated.
To legally market a property as a tourist rental, it is essential to hold a specific licence issued by the Consell Insular.
At present, there is a moratorium on the granting of new licences, meaning no new permits are being issued. Existing licences usually apply only to:
Country houses
Detached villas
Properties that meet very specific requirements
Marketing a property for holiday rental without the required licence can lead to very high financial penalties, both for the owner and for anyone who intermediates or advertises the property.
For this reason, residential apartments cannot legally be used for holiday rentals in Ibiza.

Long-term rental, also known as annual rental, is governed by the "Ley de Arrendamientos Urbanos" (LAU).
In Ibiza, there is no rent price control, but there is a legal framework that is far less flexible compared to other types of contracts, such as seasonal rentals.
This type of rental is becoming increasingly scarce due to:
Property owners’ perception of legal uncertainty
The risk of non-payment and illegal occupation
Pressure from tourism
Regulations that limit the contract’s ability to adapt
Minimum tenant commitment: 6 months
Maximum duration:
5 years if the property is owned by a private individual
7 years if it is owned by a company
Legally, to access a long-term rental:
1 month’s rent as a mandatory security deposit
1 month’s rent paid in advance
The landlord may request up to 2 additional months as extra guarantees
Although there is no rent cap, regulation significantly limits negotiation capacity—especially regarding contract duration, rent updates, and early termination. The LAU clearly protects the tenant.
Long-Term Rental
A seasonal rental contract is designed for people who need a property on a temporary basis, but not for holiday use.
In Ibiza, it is a very common option for:
Relocated workers
People in the process of moving
Stays for professional or personal reasons
From 1 month up to 11 months
The temporary nature of the tenant must be justified (work, relocation, project, etc.)
Primarily governed by the Civil Code
Supplemented by the Urban Leases Act (LAU)
This makes it a contract that is:
More flexible
Less rigid than long-term rentals
More open to negotiation
2 months’ security deposit
1 month’s rent
Seasonal Rental
Not checking what type of contract you are signing
Confusing holiday rentals with seasonal rentals
Not being clear about the required documentation
Accepting verbal agreements without having them reflected in the contract
Signing in a rush out of fear of losing the property
